WorkAdventure Full Website Terms of Service and Use

Welcome to WorkAdventure, operated by WorkAdventure. These Terms and Conditions ("Terms") govern your use of the WorkAdventure platform, including all competition micro-sites, educational services, user-generated content, and pixel-based virtual worlds ("Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. General Acceptance and Platform Scope

1.1 Acceptance of Terms

By completing the registration process or accessing any part of the Platform, you, the user, and/or the registering School/Institution (collectively, "User" or "You"), agree to comply with and be legally bound by these Terms.

1.2 User Accounts

You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account. You must notify WorkAdventure immediately of any unauthorized use of your account.

2. Platform Usage and Code of Conduct

2.1 Permitted Use

The Platform is intended for educational, competitive, and career development purposes. You agree to use the Platform only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Platform.

2.2 Prohibited Activities

You must not:

  • Engage in any form of cheating, hacking, or unauthorized access to the Platform's code or intellectual property.

  • Upload, post, or transmit any content that is unlawful, harmful, defamatory, obscene, or violates any third-party rights (including privacy and intellectual property).

  • Use the Platform to transmit unsolicited advertising or spam.

  • Engage in harassment, bullying, or discriminatory behavior toward other Users, staff, or judges.

3. Competition-Specific Rules (Binding)

3.1 Competition Integrity and Disqualification

  • Finality of Rules: All specific rules and mechanisms detailed for the Academic Olympiads, Mini Hackathons, and Learning ESports are legally binding on all participants.

  • E-Proctoring and Consent: For competitive events, participation constitutes express consent to mandatory e-proctoring, including continuous video, audio, and screen recording for verification of fair play.

  • Disqualification: WorkAdventure reserves the right to immediately disqualify any User or team for violation of competition rules, technical malpractice, or any breach of the Code of Conduct. All entry fees are non-refundable upon disqualification.

3.2 Prizes and Awards

  • Prize Allocation: Winners must claim prizes within 60 days of the official announcement. Prizes are not transferable unless expressly permitted by WorkAdventure.

  • Prize Substitution: WorkAdventure reserves the right to substitute any prize with an item of equal or greater monetary value due to supply issues or logistical constraints.

  • International Travel: Winners of the France trip must secure all necessary travel documents (passport, visa) at their own expense and are responsible for meeting all travel requirements. WorkAdventure will assist with invitation letters but does not guarantee visa approval.

4. Intellectual Property (IP) and Content Ownership

4.1 WorkAdventure IP

All content, design, functionality, software, and pixel worlds associated with the WorkAdventure Platform (excluding User Content) are the exclusive property of WorkAdventure and protected by copyright and intellectual property laws.

4.2 User-Generated Content (UGC)

  • Ownership: You retain ownership of all original content you create and submit, including Hackathon project ideas and designs.

  • License Grant: By submitting UGC to the Platform (including contest entries, forum posts, and pixel designs), you grant WorkAdventure a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, and display the UGC for Platform operation, marketing, and promotional activities, including but not limited to showcasing winning Hackathon projects.

5. Liability, Indemnification, and Dispute Resolution

5.1 Indemnification

You agree to indemnify, defend, and hold harmless WorkAdventure, its affiliates, employees, and agents from any and all claims, liabilities, costs, and expenses (including legal fees) arising from your use of the Platform or your breach of these Terms.

5.2 Limitation of Liability

To the maximum extent permitted by law, WorkAdventure shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

  • Your use or inability to use the Platform.

  • The cost of procurement of substitute services.

  • Any unauthorized access to or alteration of your transmissions or data.

  • Any breach of competition integrity by another participant.

5.3 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of [Insert City of WorkAdventure India Office].

6. Termination and Changes

6.1 Right to Terminate

WorkAdventure may, at its sole discretion, suspend or terminate your access to the Platform and any associated competitions if it believes you have violated these Terms.

6.2 Changes to Terms

WorkAdventure reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
